By order of December 7, 1995, the application for leave to appeal was held in abeyance pending the decision in People v Mezy (Docket No. 102274). On order of the Court, the decision having been issued on July 31, 1996, 453 Mich. 269, 551 N.W.2d 389 (1996), the application is again considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals, and we REMAND this case to that court for reconsideration in light of Mezy and, if necessary, defendant's other issues. Should either party promptly attempt to file a supplemental brief, or a motion contending that a remand to the trial court for proceedings related to this Court's decision in People v Mezy, (supra) , would promote judicial economy, we direct the Court of Appeals to permit such a filing. We do not retain jurisdiction.
